Agreement for All Pets

Pet Sitting /Dog Walking Service Agreement between

Personal Pet and Home Care (Business Owner) and Client

For the purposes of this document, the terms Client/Pet Owner are synonymous with the person contracting services for one or more domestic animals.  Personal Pet & Home Care, Inc. (PP&HC) is synonymous with the pet care company providing care for the Client, through the pet sitter/care giver, an independent contractor engaged by PP&HC to provide pet and home care.

Personal Pet & Home Care, Inc. provides services to the Pet Owner/Client which includes, but is not limited to: dog walking, transporting, and feeding and caring for pets. 

This agreement is entered into by and between Personal Pet & Home Care, Inc. and

Client desires to engage Personal Pet & Home Care, Inc. and its contracted pet sitters/care givers to provide pet care and agrees to the terms below:

Injury to Client animal(s) by another animal:

Personal Pet & Home Care, Inc. and its contracted staff will not be responsible for any animal(s) that instigates fights with other animals or is injured by another animal.  Personal Pet & Home Care, Inc. will take all appropriate actions to ensure that Client’s animal(s) are not placed in the company of aggressive or violent animals and/or will immediately attempt to remove Client’s animal(s) from any animal fight, consistent with the safety of the sitter.

Injury or escape of animals:

Client and sitter are aware that the highest level of care shall be given to pets under care of the sitter employed by Personal Pet & Home Care, Inc. Client is aware that pet(s) are instinctual in nature and not always controllable by the sitter even when the highest level of care is provided.  Should the Client’s animal(s) run away or be injured, the Client agrees that Personal Pet & Home Care, Inc. will not be responsible for any liability. The above waiver of liability in favor of Personal Pet & Home Care, Inc. shall not apply or be effective if Personal Pet & Home Care, Inc. conduct in providing its pet care services is found to be grossly negligent, reckless, or if there is intentional misconduct. 

Injury to Pet Sitter or another person by Client’s Animal(s):

Client will be responsible for all medical expenses and damages resulting from an injury to pet sitter or other persons by the Client’s pet(s). Client agrees to pay the full cost of medical expenses and damages should they arise to the pet sitter or the pet sitter’s possessions as a result of the Client’s animal(s) actions.  Client agrees to indemnify, hold harmless, and defend Personal Pet & Home Care, Inc. in the event of a claim by any person injured by the Client’s pet(s).

Unsafe Pet(s):

This agreement permits Personal Pet & Home Care Inc. to use its sole discretion to stop and end service at any time that it believes Client’s pet(s) poses a danger to the safety and health of itself, other pets, or Personal Pet & Home Care, Inc. pet sitters/care givers. Client will be contacted if service needs to be ended.

Off-leash Dog(s):

Clients who request off-leash activity and play for their dog(s) must initial the line below and agree that the Client’s dog(s) may be off-leash in designated dog parks, other legal-for-dog areas (e.g. fire roads, etc.) or within invisible fencing or open doggie doors on Client’s property. Client agrees that should the Client’s dog(s) run away or be injured during off-leash play time, neither Personal Pet & Home Care, Inc. nor Personal Pet & Home Care, Inc. pet sitters/care givers will be held liable for any damages resulting to people or other animals or to the Client’s dog(s).

Radio:

Service Confirmations, Payment Policy and Cancellation Policies:

Client will receive a confirmation notice from PP&HC after requesting services. It is the Client’s responsibility to carefully check dates and times of services listed in the confirmation to assure accuracy, and to contact PP&HC immediately if a change needs to be made. Payment is due upon completion of services listed on confirmation (or before for some holiday reservations. See below.). PP&HC will accept cash and local checks, electronic payment via PayPal, Venmo, and Zelle, and direct deposits made to Bank of America via the email address pet_care@sbcglobal.net. By signing this contract, Client agrees to and is aware of Personal Pet & Home Care, Inc.’s notification and cancellation policies which vary by type of service and are as follows:

Daily pet walks or in-home pet care (other than out-of-town):

Changes to daily pet walks or daily in-home pet care services listed on the confirmation must be made prior to their scheduled start time. Once the PP&HC sitter arrives at Client’s home, Client will be billed for the scheduled service. Due to liability issues, if Client or anyone else are in Client’s home at the time of scheduled services, the sitter will not stay in Client’s home any longer than it takes to satisfy pet(s)’s basic needs (walk, bathroom break, feeding, litter box cleaning, etc.), and service will be considered completed. Regular ongoing dog walk Clients (those who consistently book 10 or more visits per month between the hours of 10:00 A.M. and 5:00 P.M., and who are charged for dog walking services) agree to give two (2) weeks’ notice should Client decide to discontinue regular ongoing dog walking service.  If Client cannot or does not give two (2) weeks’ notice, Client agrees to compensate Personal Pet & Home Care, Inc. for what would have been the total for two weeks of regular dog walking service. Personal Pet & Home Care, Inc. agrees that should Client discontinue service due to blatantly poor care/service from walker for any reason, then this two (2) week notice addendum will not be enforced by Personal Pet & Home Care, Inc.

Weekly Recurring pet walks or in-home pet care (other than out-of–town):

It is the client responsibility to contact business by Saturday 7:00 P.M. of visits they need that week.  We set this time aside just for your pets and these middle of the day time periods book quickly.  Once these times and dates are set for the week, cancellation can’t be made after 7:00 P.M. on Sunday night of that week.


Out-of-town Services (during non-holiday time periods):

Changes to out-of-town services scheduled for non-holiday time periods must be made at least 24 hours before the first service date on the confirmation. Requested changes to services (including cancellations, late departures and early returns) made less than 24 hours prior to first service date on the confirmation will result in billing for all services on the confirmation as well as any addition services (extension of services) requested.

Due to liability issues, if Client or anyone else are in Client’s home at the time of scheduled services, the sitter will not stay in Client’s home any longer than it takes to satisfy the pet(s)’s basic needs (walk, bathroom break, feeding, litter box cleaning, etc.), and service will be considered completed.

Out-of-town Services scheduled over National Holidays and Spring Break:

Prior payment of services in full is due no less than two weeks prior to the holiday for reservations whose dates include any days in the school vacation period surrounding CHRISTMAS DAY/NEW YEAR’S EVE or THANKSGIVING. Prior payment is not required for reservations whose dates include Easter Weekend, Memorial Day Weekend, Fourth of July or Spring Break. Any change to the services listed on your confirmation (including cancellations, late departures and early returns), for any reservation that includes any of the holidays listed above or spring break must be made no less than one week prior to the first day of service in order to receive a refund of any amount.

Due to liability issues, if Client or anyone else are in Client’s home at the time of scheduled services, the sitter will not stay in Client’s home any longer than it takes to satisfy pet(s)’s basic needs (walk, bathroom break, feeding, litter box cleaning, etc.), and service will be considered completed.

Solicitation of Personal Pet & Home Care, Inc. Sitters:

Client agrees that the sitter provided by Personal Pet & Home Care, Inc. is employed through Personal Pet & Home Care, Inc. and is contracted to work through Personal Pet & Home Care, Inc. and not directly through the individual Client listed above.  Client agrees that all reservations for present and future pet sitting and dog walking must be made through Personal Pet & Home Care, Inc. and not the individual sitter.  The Personal Pet & Home Care, Inc. sitter may give out his/her personal number to the Client.  Client agrees to use this number only in the event of an emergency during which the sitter/walker is already employed directly through Personal Pet & Home Care, Inc. for Client.  Client agrees that this number shall not be used for any solicitation of future pet sitting or dog walking.  Client is aware that should this contract be broken, legal fees and misuse-of-staff charges will apply.

Home Access:

Personal Pet & Home Care sitters/care givers must have access to Client’s home to provide services. Client can choose to have sitters use a front door or garage key pad, key lock box, or can give PP&HC a door key. If Client chooses to give PP&HC a door key, copies of that key will be made to supply the sitter/s assigned to Client’s home with their own key. Clients who do not wish to have their key copied must use another option. Client’s key is never labeled with their name or address. Clients are strongly encouraged to give PP&HC an emergency contact and to supply that contact with a way to enter Client’s home. Although some clients request to leave a key hidden on their property for PP&HC use, this is not recommended. If Client lives in a gated or guarded community Client must supply gate access code, or if a guard is present, Client must notify them that we will need access to the community.

Client Home Care Needs:

Personal Pet & Home Care, Inc. is not responsible for wilted, dead or otherwise unhealthy plants. Sitters will follow written instructions as precisely as possible but cannot be responsible if the results are not favorable to the Client.  Please place all indoor plants together on a waterproof surface in plain sight as your pet sitter is not responsible for water-damaged areas or missed plants.

Client should always advise Personal Pet & Home Care, Inc. if someone else is entering Client’s home while they are away. Due to liability issues, if Client or anyone else are in Client’s home at the time of scheduled services, the sitter will not stay in your home any longer than it takes to satisfy pet(s)’s basic needs (walk, bathroom break, feeding, litter box cleaning, etc.), and service will be considered completed.

Personal Pet & Home Care, Inc. is not responsible for damage to the home beyond the control of the sitter. This includes, but is not limited to: electrical problems, leaks, and acts of nature. All repairs to home and related fees will be paid by Client or fully reimbursed to Personal Pet & Home Care, Inc. within seven (7) days of Client’s return date. Personal Pet & Home Care, Inc. is not responsible for any damage to the property or home of the Client unless such damage is caused by the negligent act of Personal Pet & Home Care, Inc.

Personal Pet & Home Care, Inc. is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this contract. Client agrees to secure home prior to leaving the premises. Personal Pet & Home Care, Inc. will attempt to re-secure the home according to Client instructions at the end of each visit.

Client is responsible for pet-proofing house and yard and security fences/gates/latches. Personal Pet & Home Care, Inc. will not be responsible for the safety of the pet(s) and will not be liable for the death, injury, disappearance or legal consequences of any pet(s) with unsupervised access to the outdoors, such as pets who live outdoors or who have open access through the house to the outside, such as via a dog door, or if Client has not initialed the section on this contract in regard to unleashed care of Client’s dog(s).

Pet Pictures

Animals are such wonderful models and we love to share their personality with others.  We do use pictures of your pets on Facebook, Instagram, website and other outlets occasionally. We never post your name, address or any pictures of your home or surroundings.  Your privacy is very important to us.

Pet Illness/Veterinary Care/Restocking supplies

In the event of a pet medical emergency, PP&HC will attempt to contact Client and/or Client’s stated emergency contact. If Client cannot be reached and the sitter feels that veterinary services are required, pet will be taken to your Client’s vet, or to an emergency veterinary office. Client agrees to pay all medical costs or any fees that may arise from animal(s) being ill or otherwise needing veterinary care. Additionally, Client agrees to pay Personal Pet & Home Care, Inc. $40 for transportation to the vet plus $40/per hour that the sitter spends at the veterinary office. If the sitter needs to restock supplies that the Client agrees to provide but that are not provided at the time of the sit (such as pet food or medication), Client agrees to pay Personal Pet & Home Care, Inc. a $40/restocking fee in addition to the cost of supplies.

Terms:

The terms of this contract apply to all pets owned by the Client, including any and all new pets that the Client obtains on or after the date that this contract was signed, at any and all locations the Client designates for service.

By signing below and/or e-mailing a written agreement to the terms of Personal Pet & Home Care, Inc., the Client agrees that he/she has read this agreement in its entirety and fully understands and accepts its terms and conditions.

Dog Walking Service Agreement & Contract

Personal Pet & Home Care, Inc. provides services to owners of dogs which include, but is not limited to:  walking, transporting, and caring for dogs.  This agreement is entered into by and between Debbie Monroe, Owner of Personal Pet & Home Care. Inc., and

Client Name:

Personal Pet & Home Care, Inc. provides dog walking services for Client’s dog(s) and by signing this contact, Client agrees to the terms below.

Personal Pet & Home Care, Inc. and its contracted staff will not be responsible for any animal(s) that instigate fights with other animals or is injured by another animal while in the care of Personal Pet & Home Care, Inc. contracted staff. Personal Pet & Home Care, Inc. will, however, take any and all appropriate actions to (a) ensure that Client’s dog(s) are not placed in the company of vicious, violent or aggressive dogs; and (b) immediately remove Client’s dog(s) from any animal fight or dangerous situation arising during the course of services provided by Personal Pet & Home Care, Inc.

Client will be notified immediately in the case of an animal emergency or sickness.  In the event that the Client cannot be contacted, the Client’s veterinarian shall be notified.  All veterinary bills that may occur from the above shall be the sole responsibility of the owner.

The above waiver of liability in favor of Personal Pet & Home Care, Inc. shall not apply or be effective if the Personal Pet & Home Care, Inc. conduct in providing its pet care services is found to be grossly negligent, reckless, or if there is intentional misconduct. 

Client is aware and agrees that the Client’s dog(s) may be off-leash in designated and legal-for-dogs areas (e.g. dog parks, fire roads) in order to provide maximum exercise and play for Client’s dog(s). Client agrees that should the Client’s dog(s) run away or be injured during the off-leash hike and play time, Personal Pet & Home Care, Inc. will not be held liable.  Client is aware that Insurance Company will not cover any accidents that might happen while dog is off leash.

The exception to dog(s) being off-leash under Personal Pet & Home Care, Inc. care would be if Client initials the line below:

I do not want my dog to be off-leash at any point during the walk, hike, or playtime.

Client also agrees to give Personal Pet & Home Care, Inc. two (2) weeks’ notice should Client decide to discontinue walking service. If Client does not give Personal Pet & Home Care, Inc. two (2) weeks’ notice, Client agrees to compensate Personal Pet & Home Care, Inc. for what would have been the total for two (2) weeks’ regular walks.  Personal Pet & Home Care, Inc. agrees that should Client discontinue service due to blatantly poor care/service from walker for any reason, then this two (2) week notice addendum will not be enforced by Personal Pet & Home Care, Inc.
